Vermilion County State's Attorney Lacy and State's Attorneys of 34 other Counties Call for Illinois' Ban on Firearms to be Ruled Unconstitutional

Vermilion County State’s Attorney Jacqueline M. Lacy, along with the State’s Attorneys of 34 other Illinois counties, has filed an amicus brief in the U.S. Court of Appeals‘ Seventh Circuit, arguing Illinois‘ ban on so–called assault weapons is unconstitutional.

In the amicus brief, also known as a friend–of–the–court brief, the State’s Attorneys argue that the ban enacted by the Illinois legislature is unconstitutional because it broadly bans entire categories of firearms that are widely owned by law–abiding Illinoisans, and the ban does not follow the historical tradition of firearm regulation in the United States.

Madison County State’s Attorney Tom Haine is the lead attorney in the amicus brief. Additional counsel for the brief are the State’s Attorneys of Brown, Calhoun, Carroll, Christian, Clark, Clay, Clinton, Cumberland, Edwards, Effingham, Gallatin, Hancock, Henry, Iroquois, Jasper, Jefferson, Jersey, Jo Daviess, Johnson, Livingston, Marion, Mercer, Monroe, Ogle, Perry, Pulaski, Schuyler, Scott, Union, Vermilion, Warren, Washington, White and Woodford counties.

“State’s Attorneys have a duty to ensure that the laws we enforce are Constitutional,” Haine said. “But this patently–unconstitutional law – which purports to ban a type of firearm far more common than the Ford F–150 while accounting for only a tiny portion of violent crime in our state and nation threatens the basic constitutional rights of the law–abiding citizens we are sworn to protect. Therefore, I am happy to partner with so many other Illinois State’s Attorneys in asking the Seventh Circuit to affirm Judge McGlynn’s excellent opinion, throw out this law, and protect our basic right of effective self–defense of hearth and home in Illinois and the rest of America.”

The ban was approved by the Illinois legislature in January 2023. It bans the sale, purchase and manufacturing of firearms that the legislature defined as “assault weapons,” such as AR–15–style rifles. The amicus brief was filed in an appeal currently before the U.S. Court of Appeals for the Seventh Circuit and stems from a challenge to the ban filed in U.S. District Court for the Southern District of Illinois. In November 2024, the Honorable U.S. District Judge Stephen McGlynn found the ban to be unconstitutional; an appeal of his ruling is now before the Seventh Circuit.

In the amicus brief, Haine notes that some firearms “may seem excessive and menacing to those with little experience with firearms, but they are quite normal and valuable to millions of responsible, law- abiding Americans. In fact, it is the experience of (the State’s Attorneys), as the chief law–enforcement

officers of our respective counties, that the overwhelmingly common use of such firearms is self- defense and recreation – for which they are well–suited – and not violent crime.”

In the brief, Haine also notes that shootings and violence are heartbreaking reminders of the pain and sorrow caused by violent individuals who have evil intentions.

“As prosecutors, we go to work every day to deter such crimes, command justice for victims, put those who do harm to our communities behind bars, and protect our residents by strengthening the justice system and enforcing the rule of law,” the brief argues. “It is in service to that same rule of law that we urge this honorable Court to support and uphold the Constitutionally protected rights enshrined in the Second Amendment – the right of the people to own commonplace firearms so they can defend hearth and home and live freely with the means to secure their own and others‘ ultimate safety.” The amicus brief was filed by the following State’s Attorneys:

Michael Hill, State’s Attorney of Brown County

Lucas Fanning, State’s Attorney of Calhoun County

Aaron Kaney, State’s Attorney of Carroll County

John H. McWard, State’s Attorney of Christian County

Armed Robbery Results in 9 Year Prison Sentence

On June 9, 2025, KeShawn Stapleton (DOB: 5/30/2002), formerly of Danville, Illinois, pleaded guilty to Aggravated Robbery, a class 1 felony and was sentenced to 9 years in the Illinois Department of Corrections. Following his term of imprisonment, Stapleton will serve one year of mandatory supervised release. The plea and sentencing hearing were presided over by Judge Karen Wall. The People presented evidence that on October 26, 2023, a Danville resident in the area of Lewis Street was walking to the trash dumpster around 9:40 A.M. when he was surrounded by five black males. The suspects held the victim at gunpoint and stole the victim’s backpack, which contained an Xbox, the victim’s cell phone and took the victim’s shoes from his feet. The crime was captured on a security camera. As the victim was providing descriptions to detectives with the Danville Police Department, there was a call regarding robbery suspects running towards Moore Street. Police responded to the area and observed several black males exiting a red Ford sedan in front of a residence on Moore Street. One of the males was identified as KeShawn Stapleton and the clothing he was wearing at the time of police contact matched the clothing he was wearing during the crime that was captured on video. KeShawn Stapleton was identified in the surveillance video of the robbery removing the victim’s shoes from his feet. The vehicle was searched and the victim’s shoes and cell phone were located inside the vehicle. Co-defendant Alvin Daniels was sentenced to 5 years in the Illinois Department of Corrections on February 5, 2025. Another co-defendant, a minor, has been charged. State’s Attorney Jacqueline Lacy said, “I commend the Danville Police Department for quickly identifying and apprehending these violent offenders. We are grateful to the victim for coming forward. Armed robbery is a dangerous crime that threatens the safety of our entire community. My office remains committed to working with the police to pursue justice and protect victims of violent crime.” THIS IS AN ONGOING INVESTIGATION. MEMBERS OF THE PUBLIC ARE ENCOURAGED TO REPORT RELEVANT INFORMATION TO LAW ENFORCEMENT.

Eight-Year Prison Sentence for Possession of Methamphetamine with Intent to Deliver

On May 15, 2025, Dylan Williams (DOB: 1/26/1995), formerly of Danville, Illinois, pleaded guilty to Unlawful Possession of Methamphetamine with Intent to Deliver, a class X felony. Williams was sentenced to 8 years in the Illinois Department of Corrections, to be followed by a term of 18 months mandatory supervised release. The plea and sentencing were presided over by Judge Karen Wall. The People presented evidence that on March 26, 2024 after 8:00 P.M., Vermilion County Sheriff’s Deputies were dispatched in regards to a vehicle fleeing a traffic stop that began in Montgomery County, Indiana. The driver entered Illinois driving westbound on I-74. The driver, later identified as Dylan Williams, was seen throwing items from the vehicle. Williams eventually lost control of the car and came to a stop between mile markers 211 and 210. The defendant exited the driver’s seat upon command and a white powder-like substance fell from his lap. Upon their approach, police saw a residue suspected to be methamphetamine all down the front of the defendant’s clothing, shoes, on his hands and on the outside of the driver’s side of the vehicle. Upon search of the vehicle, officers located methamphetamine in the driver’s floorboard, the driver’s side door and the area of the center console, as well as other areas of the passenger side of the vehicle. Later, following his arrest, as the defendant exited the squad car officers located chunks of methamphetamine and the residue that fell off Williams’ person. Deputies located more than 55 grams of methamphetamine in total. Laboratory testing by the Illinois State Police Crime Lab confirmed that the substance was methamphetamine. State’s Attorney Jacqueline Lacy thanked the Vermilion County Sheriff’s Department for apprehending this defendant. She said, “This case highlights the serious threat posed by those who traffic dangerous drugs like methamphetamine through our communities. This defendant put innocent lives at risk by leading law enforcement on a chase across state lines. This sentence sends a clear message that drug dealers will be held accountable.”

Defendant Sentenced to 12 Years in Prison for Violence at a Family Gathering

On May 16, 2025, Malik Noye (DOB: 4/1/2002), formerly of Danville, Illinois, pleaded guilty to Attempt Aggravated Battery with a Firearm, a class 1 felony. Noye was sentenced to 12 years in the Illinois Department of Corrections and following his term of imprisonment will serve 1 year of mandatory supervised release. The plea and sentencing hearing were presided over by Judge Mark Goodwin. The People presented evidence that on July 4, 2022, Malik Noye was at a gathering of family and friends. A storm was approaching so a clean-up of the party began. The victim was holding the door open for people when Noye bumped into the victim. Noye and the victim argued and then Noye pulled out a gun. A struggle ensued and the gun discharged. The victim ran away but Noye chased and shot at the victim. Noye then fled the scene. The victim did not suffer life threatening injuries and no other individuals were injured. State’s Attorney Jacqueline Lacy said, “This defendant’s choice to turn a personal dispute into an act of armed violence, especially in the presence of innocent family and friends, demonstrates a reckless disregard for human life. My office remains committed to working with law enforcement to ensure that violent offenders are held fully accountable for their actions and to ensure the safety of our community.”

Repeat Offender Sentenced to 10 Years for Armed Robbery & Unlawful Use of Firearm

On May 22, 2025, Jalen Coe (DOB: 4/15/2003), formerly of Danville, Illinois, pleaded guilty in two separate cases to Armed Robbery, a class X felony, and to Aggravated Unlawful Use of a Weapon, a class 4 felony for a sentence of 10 years in the Illinois Department of Corrections. Following his term of imprisonment, Coe will serve 18 months of mandatory supervised release. The plea and sentencing were presided over by Judge Karen Wall. The People presented evidence that on January 2, 2024, Danville Police were dispatched to East Robinson Street from a moving vehicle. Police stopped the car, and the victim got out. At this point, the suspect moved into the driver’s seat and fled from police, but eventually crashed the car. Police were able to identify Jalen Coe as the driver. Coe fled the scene of the crash on foot. Police searched the vehicle after the crash and located a machine gun on the passenger side. During the investigation, the victim stated that after a text exchange, he agreed to bring money and cannabis to a residence on Robinson Street. Once the victim arrived inside the residence, Jalen Coe appeared from another room with a firearm, threatened the victim and robbed the victim of United States currency. Coe forced the victim into his own vehicle, and forced the victim to drive him around to look for an ATM to get more money. At some point the victim was able to call 911 and left the line open, leading police to their location. The People also presented evidence that on October 21, 2021, Danville Police responded to the area of Fowler Street for a report of shots fired. Upon arrival, officers saw two individuals who matched the description of the suspects, one of them being Jalen Coe, and stopped them for questioning. As police attempted to pat down the suspects, Coe fled on foot despite officer’s commands to stop but was eventually apprehended. Located near Coe was a loaded handgun. DNA swabs were collected from Coe and the gun. Testing by the Illinois State Police Crime Lab confirmed Coe had possessed the firearm. State’s Attorney Jacqueline Lacy said, “This sentence sends a clear message that violent crime results in serious consequences. I commend the Danville Police Department for bringing this repeat offender to justice and for protecting the good People of Vermilion County from armed violence.”

Police Investigation Leads to 12 Year Prison Sentence for Convenience Store Robbery

On May 15, 2025 Devante Boyd (DOB: 1/26/1995) formerly of Danville, Illinois, pleaded guilty to Armed Robbery, a class X felony, and was sentenced to 12 years in the Illinois Department of Corrections. Boyd will serve 18 months mandatory supervised release following his release from prison. Judge Karen Wall presided over the plea and sentencing. The People presented evidence that on August 7, 2022, an employee of a convenience store on Gilbert Street in Danville, was approached outside the building by two men, one of whom was carrying a shotgun. Both men followed the victim into the store. The man with the shotgun ordered the victim to empty a cash register into a bag, stealing over $300.00 in United States Currency. The second man filled a trash bag with cigarettes and cigars. Both men then exited the store and fled northbound. A short distance to the north, the clothing worn by the suspects was found discarded. DNA found on the clothing was tested and matched Devante Boyd. Additionally, records obtained through a search warrant showed Boyd’s cell phone was at the store during the robbery and at the location where the clothing was found. The second suspect has not been identified. State’s Attorney Jacqueline Lacy thanked the Danville Police Department for their efforts during the investigation of this case. She added, "Armed robbery is a violent crime that endangers innocent lives and undermines the safety of our entire community. My office is fully committed to ensuring that those who commit these offenses face serious consequences for their actions." THIS IS AN ONGOING INVESTIGATION.
